This is the code he was booked under    402.  (a) (1) Every person who goes to the scene of an emergency, or stops at the scene of an emergency, for the purpose of viewing the scene or the activities of police officers, firefighters, emergency medical, or other emergency personnel, or military personnel coping with the emergency in the course of their duties during the time it is necessary for emergency vehicles or those personnel to be at the scene of the emergency or to be moving to or from the scene of the emergency for the purpose of protecting lives or property, unless it is part of the duties of that person’s employment to view that scene or those activities, and thereby impedes police officers, firefighters, emergency medical, or other emergency personnel or military personnel, in the performance of their duties in coping with the emergency, is guilty of a misdemeanor.

  10. I think the deputy didn’t either read the statute fully or, doesn’t know the meaning of “impede”. Simply being present and viewing is not the corpus of the crime. The impeding of emergency personnel is what completes the crime. It’s obvious from the video that none of the officers or firefighters had a problem with you being present or viewing since you were not impeding their activity. The officer arrived and was not directly involved in the operation. He had not been given direction from the Incident Commander or Senior Officer at scene to clear the sidewalk or cordon off the area. The Watch Commander is also suppose to review any reports or evidence prior to giving booking approval. The officer is suppose to file a “Probable Cause for Arrest” statement to an on-call magistrate. Seems like you just got caught in a tangled web of lies. It’s clear from the video you have another good case for false arrest. Go get em’!

  24. Call your pol person in Sacrament and let them know the 148.g is now being gone around by cops using 402. Broadly written it says Every person. It allows the cops to make that determination. The ACLU needs to fight this.
