I am concerned that SCOTUS might not find strong legal grounds to strike down government coercion on 1A grounds…
Firstly, Congress didn't pass any laws forcing private social media companies to ban speech. So, the most literal reading of 1A doesn't apply.
That said, the justices have been asking about the legal grounds and harm created for plaintiffs… One of them asked if the social media companies should be the ones bringing the lawsuit if they feel harmed as government forcing those companies to ban speech would be violating the free speech of the social media company specifically.
I'm trying to give this the fairest read I can and it really doesn't feel like the plaintiffs are on solid ground here.
